This is a legal agreement between RetailEcho (“Licensor”) and you (“Licensee”). By purchasing, downloading, or using any content from RetailEcho, you accept this agreement in full. “Content” means any image, photograph, illustration, graphic, video, or other media downloaded from RetailEcho.
RetailEcho sells commercial-use and editorial-use content. Your rights depend on the license type purchased.
By using RetailEcho.com and/or downloading any content from this site, you agree to be bound by this agreement. This agreement applies to you personally and, if you are using the site on behalf of a client, to you and your client(s).
We reserve the right to update or modify this agreement at any time without prior notice. Similarly, we may adjust our pricing structure at our discretion, including changes influenced by our community, media database, or market conditions. Your use of the site is subject to the most current version of this agreement posted on RetailEcho.com at the time of your use.
By accessing, downloading, uploading, or using any media on RetailEcho.com, you agree to comply with this agreement. If you do not agree with any part of this Agreement, please discontinue use of the site and delete any content you have downloaded.
Where RetailEcho.com provides a translation of the English-language version of these terms for convenience, the English version shall govern in all cases. In the event of any conflict between the English version and a translation, the English version shall take precedence.
This is a license agreement between you and RetailEcho that explains how you may use the photos and video clips you license from us. By downloading or using any content from RetailEcho, you agree to the terms of this license agreement.
1. GENERAL RIGHTS GRANTED
RetailEcho grants you a non-exclusive, non-transferable, worldwide, perpetual license to use the content only as explicitly permitted under the applicable commercial license or editorial license.
You are not purchasing the copyright. All ownership remains with RetailEcho or its contributors.
2. LICENSE TYPES
2.1 Editorial License
If the content is marked “Editorial Use Only”, it is intended strictly for descriptive purposes. Examples that you may use it for:
News reporting
Blogs, news websites, articles
Textbooks or educational materials
Research or analysis
Documentaries (non-advertising)
Journalistic or informational contexts
Editorial content may NOT be used for:
Advertising
Marketing or promotions
Product packaging
Merchandising or resale
Endorsement or commercial messaging
Editorial content may contain:
Trademarks, logos, brand names
Retail stores
Real product packaging
Recognizable people (unreleased)
Store signage and branding
Architectural features
Corporate interiors
RetailEcho does not provide releases for editorial content.
2.2 Commercial License
If the Content is marked “Commercial License”, you may use it in:
Advertising and promotions
Packaging and labels
Marketing materials
Merchandising
Websites and apps
Corporate presentations
Commercial video productions
2.2(a) Buyer Is Fully Responsible for Clearances
Regardless of license type: RetailEcho does NOT provide model releases, property releases, trademark permissions, store/location permissions, or any other clearance.
If your commercial use requires a release, you must obtain it yourself.
RetailEcho does not guarantee that any content is released for commercial use.
3. PROHIBITED USES (APPLIES TO ALL CONTENT)
You may NOT:
Use content in a pornographic, defamatory, or illegal manner
Claim RetailEcho endorses your use
Use content as a trademark or logo
Sell or redistribute content as a standalone file
Use content in AI training datasets
Alter editorial content in a misleading manner
Use editorial content in any commercial/advertising context
Misrepresent brand or store endorsement
Use content deceptively or falsely
4. ATTRIBUTION
Attribution is required for editorial uses when reasonably possible: “RetailEcho.com”.
Attribution is recommended but not required for Commercial uses.
5. NO RELEASES PROVIDED
RetailEcho does not provide, claim to have, or warrant the availability of:
Model releases
Property releases
Trademark permissions
Store or corporate approvals
Rights of publicity clearance
Copyright clearance for trademarks/labels/signage
You must independently obtain any necessary permissions for your intended use.
6. NO WARRANTY / AS-IS DISCLAIMER
All content is provided “AS IS”, including:
No warranty of accuracy in captions or metadata
No warranty that use is free of third-party rights
No warranty of fitness for any purpose
No warranty of legal compliance
No warranty regarding releases
No warranty regarding ownership of depicted brands/products
RetailEcho does not guarantee that any content is cleared for commercial use, even if sold under a commercial license.
7. BUYER’S RESPONSIBILITIES
You are entirely responsible for:
Determining legality of your use
Obtaining model releases
Obtaining property releases
Obtaining trademark permissions
Avoiding any implied endorsement
Complying with advertising laws
Avoiding privacy/publicity violations
Complying with store/corporate restrictions
Avoiding deceptive alterations
Paying any required third-party royalties or fees
This responsibility applies to all uses under both license types.
8. No Standalone File Use
You may not use RetailEcho content in any way that allows it to be downloaded, extracted, or redistributed as a standalone file (i.e., separate from your project or end use).
Commitment to Ethical and Lawful Use
RetailEcho is committed to ensuring our content is used responsibly, ethically, and in compliance with legal standards. By using our content, you agree to follow this policy. Failure to do so may result in termination of your license, removal of access, or legal action.
Respectful Use: Content featuring recognizable individuals may not be used in a way that is offensive, misleading, or harmful to their reputation.
No Unaltered Resale: You may not sell or distribute photos or videos in their original, unmodified form (for example, as posters, prints, or on physical products). Content must be incorporated into a larger design, project, or product.
No Implied Endorsements: You may not suggest or imply that any person, business, or brand shown in RetailEcho content endorses your product, service, or message.
No Redistribution: Our photos, videos and other media cannot be resold, shared, or redistributed on other stock media platforms, wallpaper sites, or similar services.
No Trademark Use: Content may not be used as part of a trademark, service mark, business name, or logo
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law: RetailEcho’s total liability under this agreement is $0.00 (ZERO).
RetailEcho is not liable for:
Any damages or losses
Attorney fees or legal expenses
Copyright, privacy, or trademark claims
Claims relating to releases or permissions
Claims relating to brands, stores, or corporations
Claims arising from metadata accuracy
Claims arising from buyer misuse
Any indirect, incidental, or consequential damages
This limitation applies even if RetailEcho was advised of potential claims.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless RetailEcho, its owners, contributors, employees, and affiliates from any and all claims, including:
Legal fees
Damages or judgments
Third-party claims
Trademark disputes
Privacy or publicity claims
Copyright claims
Claims regarding store/corporate policy
Your use or misuse of content
Your failure to obtain releases
Any breach of this Agreement
You bear 100% of the legal responsibility for your use of the content.
12. CONTENT WITHDRAWAL
RetailEcho may remove or revoke content if it becomes aware of a potential rights issue. You agree to:
Stop using the affected content
Delete all copies
Remove it from products and media
Confirm compliance upon request
Your sole remedy is replacement content.
13. TERMINATION
RetailEcho may terminate this agreement if you violate any terms.
Upon termination, you must:
Stop using the content
Delete all copies
Confirm deletion if requested
14. GOVERNING LAW
This Agreement is governed by the laws of Colorado, United States.
15. ENTIRE AGREEMENT
This agreement constitutes the entire understanding between you and RetailEcho and supersedes any prior agreements or communications regarding licensing of the content.
16. MOST CURRENT LICENSE VERSION CONTROLS
The version of this license agreement posted on RetailEcho.com is the current, official, and controlling version of this agreement. RetailEcho may update or modify this agreement at any time. All changes become effective upon posting to RetailEcho.com. If any printed, saved, cached, downloaded, or earlier version of this agreement conflicts with the version currently posted on RetailEcho.com: The version posted on RetailEcho.com prevails and supersedes all prior versions. It is the licensee’s responsibility to review the current license agreement to ensure compliance.
17. ACCEPTANCE
By purchasing, downloading, or using content from RetailEcho, you acknowledge that:

- You understand it
- You agree to be bound by all terms
